Divorce

You can use I-CAN! to initiate a divorce action if:
  1. You have lived continuously apart for at least a year and a day with the intention that the separation be permanent, AND
  2. Either you or your spouse has lived in North Carolina for more than 6 months.
WARNING: A divorce ends your rights to the property acquired during the marriage (including cars, houses and furniture), child support and spousal support UNLESS the court has already made decisions on these issues. Consult with an attorney so that you can resolve these issues before the divorce becomes final.

I-CAN! will fill out the forms for you by asking you simple questions and putting your answers on the court forms. I-CAN! will also print instructions to tell you what to do with your forms, and how the court process works.

The fee to print your Divorce forms is $20. You can pay with a credit card or a debit card.

I-CAN! will print the following forms that are necessary for your individual situation out of the following forms:
  • Complaint for Divorce, Affidavit of Service of Process by Registered or Certified Mail, Motion for Summary Judgment and Notice of Hearing, Jugment of Divorce, and forms for serving on the defendant

Name Change

Changing the name on a birth certificate, for an adult or a minor, requires a court order. The I-CAN! Name Change module allows a person who is at least 18 years old to change their own name; or a parent of a minor child, who has the consent of the other parent, to change the minor child’s name; or a 16 or 17 year old, who has the consent of their custodial parent, to change their own name.

The I-CAN! Name Change module is not for guardians seeking to change the name of a minor child and it is not for a person who is seeking to resume their maiden name.

I-CAN! will fill out the forms for you by asking you simple questions and putting your answers on the court forms in the correct place. I-CAN! will also print instructions to tell you what to do with your forms, and how the court process works.

The fee to print your Name Change forms is $20. You can pay with a credit card or a debit card.

I-CAN! will print the forms that are necessary for your individual situation out of the following forms:
  • Adult Name Change: Petition for Name Change, Notice of Intent to File Name Change, Affidavit of Character
  • Child Name Change: Petition for Name Change (Minor), Notice of Intent to File Name Change on Behalf of a Minor, Affidavit of Parental Consent, Affidavit of Character

Custody and Visitation

You can use I-CAN! to create the following sets of forms:
  1. File a complaint for custody and visitation (as a parent or another interested person)
  2. Respond to a complaint with an answer and counterclaim
  3. Change your current order
  4. File a contempt motion (if the other party has willfully violated the order)
I-CAN! will fill out the forms for you by asking you simple questions and putting your answers on the court forms in the correct place. I-CAN! will also print instructions to tell you what to do with your forms, and how the court process works.

The fee to print your Custody forms is $20. After you pay you can print your forms, come back and update your information and/or reprint your forms as often as you would like. The fee applies to each type of Custody forms. For example, if you create forms to file a complaint, you will be charged again if you want to create forms to file a contempt motion later. You can pay with a credit card or a debit card.

I-CAN! will print the forms that are necessary for your individual situation out of the following forms:
  • Complaint for Child Custody or Visitation; Non-Parent Complaint for Child Custody or Visitation; Affidavit of Service of Process; Notice of Hearing;
  • Motion for Modification of Custody and/or visitation order; Affidavit of Service
  • Answer and Counterclaim to complaint for custody or visitation; Affidavit of Service
  • Motion for Order to Show cause; Order to Appear and Show Cause for Failure to Comply; Affidavit of Service
