Divorce

Divorce allows husband and wife to terminate the bonds of marriage.
You can use I-CAN!™ to initiate a divorce action if:
  1. You have lived continuously separate and apart for at least one year and one day with the intention that the separation be permanent, AND
  2. Either you or your spouse has lived in Mecklenburg County, NC for more than 6 months.
WARNING: Divorce terminates the right to marital property, post separation support and/or alimony UNLESS such claims have already been determined or properly filed prior to the entry of the divorce judgment. Marital property is any property that is acquired during the marriage, including but not limited to cars, houses and furniture. These are complicated issues and require parties to consult an attorney. The failure to assert a claim timely will cut off the right to those claims in the future.

I-CAN!™ will fill out the forms for you by asking you simple questions and putting your answers on the court forms in the correct place. I-CAN!™ will also print instructions to tell you what to do with your forms, and how the court process works.

I-CAN!™ will print all of the forms that are necessary for your individual situation out of the following forms:
  • Complaint for Divorce, Civil Action Cover Sheet, Civil Summons, Affidavit of Service of Process by Registered or Certified Mail, Motion for Summary Judgment and Notice of Hearing, Certificate of Absolute Divorce or Annulment, Jugment of Divorce, and forms for serving on the defendant
You can enter your information for free, however you will pay $20 using a credit card or E-Check to print your forms. You can use the software as often as you like once you have paid this fee.

Name Change

The I-CAN!™ Name Change module allows a party to petition the court to legally change their name. Changing the name on a birth certificate, for an adult or a minor, requires a court order. The Name Change module allows a person who is at least 18 years old to change their own name; OR a parent of a minor child who has the consent of the other parent, to change the minor child's name; OR a 16 or 17 year old, who has the consent of their custodial parent, to change their own name.

The I-CAN!™ Name Change module is not for guardians or guardian ad litems, seeking to change the name of a minor child and it is not for a person who is seeking to resume their maiden name.

You may want to change a name because of marriage, divorce, adoption or simply a desire to have another name. Generally, a party cannot change their name for a fraudulent purpose, such as avoiding debts, or when other people's rights can be affected. Use of a curse word as a name is not recommended. When changing the name of a minor, the court looks to the best interest of the minor.

Domestic Violence Protective Order

If you are the victim of Domestic Violence you can use I-CAN! to complete the court forms required to request a domestic violence protective order. You can also request temporary orders for child custody, child support and spousal support.

I-CAN!™ will fill out the forms for you by asking you simple questions and putting your answers on the court forms in the correct place. I-CAN!™ will also print instructions to tell you what to do with your forms, and how the court process works.

When you file the forms with the court, you will typically be scheduled to appear before the a judge the same day or the next business day. The Judge will make a ruling and set a date for a hearing for you and the alleged abuser to come to court.

Small Claims

Small Claims Court is an informal court where disputes are resolved quickly and inexpensively. The person who sues is called the plaintiff. The person who is sued is called the defendant. You may use I-CAN!™ to file a small claim if you are at least 18 years old, suing for property or money worth $5,000 or less and suing a defendant that resides or is located in Mecklenburg County.

I-CAN!™ will print all the forms necessary to file a small claim for money owed, the recovery of specific personal property, or summary ejectment (eviction). I-CAN!™ will fill out the forms for you by asking you simple questions and putting your answers on the court forms in the correct place. I-CAN!™ will also print instructions to tell you what to do with your forms, and how the court process works.

Child Custody, Visitation and Support

If you want child custody, visitation and/or child support you can use I-CAN! to complete your forms. You do not have to be the parent to request child custody, visitation and/or child support using I-CAN!™
