There must be either a written or oral understanding concerning the payment of rent in order to seek relief. <h4>What is an Answer and Counterclaim for Summary Ejectment?</h4> <p>The packet available in the SelfServe Center and online allows a defendant to respond to a Complaint for Summary Ejectment. The Answer and Counterclaim allows you to file a document telling the judge which parts of the Plaintiff s Complaint that you agree and disagree with AND ALLEGE ANY FURTHER CLAIMS AGAINST THE PLAINTIFF.</p><p> YOU MUST FILE THESE DOCUMENTS WITH THE COURT IF YOU WANT THE LANDLORD TO REFUND ANY OF YOUR MONEY. Therefore, we cannot tell you if you should petition, but we can tell you that you must follow the procedure explained in the following pages.</p> <p><b>Legal Terms</b> Certain legal terms will be used throughout your proceeding. Staff CANNOT provide legal advice, but can provide procedural information and definitions of legal terms.</p> <p><b>What do I do first?</b> <ol> <li>After you get the packet, READ THE INSTRUCTIONS! Then fill out the forms by typing or printing neatly in ink. You may fill them out at home or at the courthouse. </li> <li>Make copies of all of the documents you complete and keep a copy in a safe place for your records.</li> <li>There is no fee to file the Answer and Counterclaim. Take your completed forms and 2 copies to the Civil Filing Department (Clerk's Office) at 832 E. 4th Street, Suite 3725 to be filed.</li> </ol></p> <p><b>IMPORTANT REMINDERS BEFORE YOU BEGIN</b> Your case involves complicated legal issues!
